Kevin Kemp

Kevin received his undergraduate education at the University of Saskatchewan, College of Commerce and obtained his law degree from Osgoode Hall Law School in 1989. In 1991, Kevin began practicing at a seven-sister law firm in downtown Toronto where he routinely defended physicians in medical negligence actions.  Kevin left that firm to establish his own plaintiff-side practice in 1993.

Kevin has achieved multiple settlements of more than $10,000,000.00 (expressed in 2023 dollars) acting on behalf of children who have suffered cerebral palsy and profound neurological injury as the result of medical negligence. When acting on behalf of victims of medical malpractice Kevin has enjoyed a success rate (either by settlement or Judgment) in excess of 90% in cases that have proceeded through examinations for discovery.

A little more about Kevin.

Kevin has represented musicians Alannah Myles, Randy Bachman, Crash Test Dummies, Shawn Desman, Loreena McKennitt, Parachute Club, Arnold Lanni (Sheriff, Frozen Ghost), Finger Eleven (then known as Rainbow Butt Monkeys), Myles Goodwyn (April Wine), Skydiggers as well as the composer of the Hockey Night in Canada Theme. He has achieved settlements on behalf of plaintiffs against well-funded adversaries including: the National Post, the Canadian Broadcasting Corporation, the Ontario Provincial Police, the Toronto Police Service, the Guelph Police Service, HSBC Bank, the Toronto Transit Commission, McCain Foods as well as several municipalities and music publishing corporations.

Kevin joined Breedon Litigation as Counsel in 2023. Kevin and Ryan met as opposing counsel in 2005 and subsequently bonded over their mutual love of cars that drive very, very fast. Kevin is the proud father of three children and grandfather of one.

Our Cases

L v. S et al (Confidential Settlement)

Medical negligence/wrongful death case involving an elderly patient who was admitted to hospital under a “Form 1” for suicidal behaviour.  The patient was inadequately monitored and committed suicide on the hospital premises.  Kevin acted for the spouse and daughter of the deceased. The case settled for $300,000 ($373,000 in 2023 dollars).

D. v. ? (Confidential Settlement)

Medical negligence/wrongful death case involving a patient whose use of Demerol was not properly monitored by family physician resulting in a fatal overdose. Kevin acted for the spouse and daughters of the deceased.  Case settled for $450,000 ($657,000 in 2023 dollars)

S. v. G et al. (Confidential Settlement)

Medical negligence case involving a child injured at birth.  The child’s delivery was delayed when nurses failed to notify the obstetrician of a non-reassuring fetal heart rate resulting in permanent neurological injury.  Kevin and Ryan acted for the plaintiffs.  The case settled at pre-trial for $11.25 Million.
